Mesothelioma as a disease was a relative latecomer among the types of cancer. As late as 1960, many doctors disputed that it was a distinct form of cancer, and often described it simply as an atypical form of lung cancer. Oncologists currently use three different mesothelioma-staging systems to diagnose and treat pleural mesothelioma. Each system measures different variables including the extent of the cancer, lymph node involvement, and metastasis.

Butchart System

The Butchart System is the oldest and most commonly used mesothelioma cancer staging system and is primarily based on the extent of the tumor mass.

Stage III – Mesothelioma has entered the chest wall, muscle, heart, esophagus, ribs, and vital organs in the pleural cavity on the same side. Lymph nodes may or may not be affected on the side of the tumor.
Stage IV – Mesothelioma has spread to the lymph nodes in the chest area on the other side of the tumor, or has spread to the pleural cavity or lung on the other side, or has reached organs in the abdominal area or neck. Any metastasis is involved in the fourth stage.

Brigham System

This is the latest mesothelioma cancer staging system and is based on tumor resectability (ability to surgically remove) and the status of lymph nodes.
Stage I – Mesothelioma is resectable and lymph nodes are not involved.
Stage II – Mesothelioma is resectable, but lymph nodes are involved.

Bethlehem Steel owned the Bethlehem Sparrows Point Shipyard at Sparrows Point, Maryland from 1916 to 1997 where it built and repaired ships during WWI and WWII. The company’s 180,000 shipyard workers were exposed to asbestos used in the construction of over 1,000 ships. A pleural effusion is an accumulation of fluid in the pleural space that is caused by irritation of either or both pleural membranes that line the lungs and chest wall. When the air sacs in the lung are compressed they cannot bring oxygen into the lungs, or get rid of carbon dioxide until they are reinflated.

Pleural effusions often resolve by themselves as the body gradually reabsorbs the fluid. However, a couple complications can arise. Because the nearby portion of the lung is squeezed closed, mucus that is trapped there can become infected resulting in pneumonia. The pleural lung lining is actually two layers of elastic membrane that glide against one another over a layer of lubricating fluid. One layer lines the chest wall and the other surrounds the lungs. Pleural Mesothelioma

Estimates are that 90% of all cases of mesothelioma are caused by asbestos. Research by the Mayo Clinic identified the cause of mesothelioma to be genetic mutation that causes the cells to become cancerous. Asbestos appears to have the capability of initiating this mutation.

Other causes of mesothelioma suggest that the Simian virus (SV40) is one cause of the disease. The SV40 virus was discovered when polio vaccines were being developed during the mid-1950s to early 1960. Some of the vaccines were contaminated with the SV40 virus.

Public Health Emergency in Libby, Montana

For the first time, the Environmental Protection Agency has declared a public health emergency. This is due to the high number of asbestos-related illnesses suffered by the population of Libby, Montana. The town will receive more than $130 million for cleanup and medical needs.

It is estimated that 200 people have died and at least a thousand more have been sickened with illnesses, including mesothelioma. The culprit is the vermiculite mine that was operated from the 1920s to 1990. Vermiculite by itself is not necessarily harmful, however, the vermiculite from the Libby mine was contaminated with asbestos.

Vermiculite is used in a variety of materials, and the vermiculite the Libby mine was mostly used in Zonolite, an insulation used in millions of homes across the country. Virtually all the vermiculite that was mined was contaminated with asbestos. This means that the small town was exposed for decades as the mining was in progress. However, while those who mined the vermiculite were definitely exposed, entire families may have also been sickened. Mine waste, called trailings, were used as mulch in gardens, as fill for driveways, and even in playgrounds and the local high school track.

The mine operator, W.C. Grace, closed the mine in 1999, but cleanup efforts have stalled time and again over the last decade. In 2008, three executives of the mining company were acquitted of criminal charges related to the town’s exposure. However, they agreed in 2008 to pay the EPA $250 million for cleanup costs.

What Effects Can Asbestos Have on the Body?

The Hill-Burton Act was passed to ensure that there was adequate infrastructure in place to provide medical care to all communities. James Cavette v Johns Manville

First Claims

Asbestos has been known as one of the most dangerous risks to employees' health since the late 1920s. In 1927 the first workers' compensation claim for asbestosis was filed. Johns Manville, a well-known asbestos company settled a 1933 claim with eleven employees, all of whom had asbestosis. The settlement was contingent upon a stipulation that the plaintiffs' attorney agreed never again to "directly or indirectly participate in the bringing of new actions against the Corporation."

The Floodgates Open

Johns Manville was again the subject of a lawsuit in 1982 in which the judgment awarded plaintiff James Cavett $3.8 million in damages. Two months later, still faced with 16,500 asbestos lawsuits The Manville Corporation filed for bankruptcy.

The 1980s and 1990s saw a flood of asbestos claims, and many of these ended up on the U.S. Supreme Court docket as class actions. Many large corporations ended up in or near bankruptcy as a result.

Tipping the Scales of Justice

Some made efforts to limit their liability by attempting to design settlements that were less than ideal. Two major faults with proposed plans were the lack of consideration for future claimants who had not yet shown symptoms of disease, and putting all of those exposed to asbestos into a single class that had no commonality other than exposure to asbestos, thus failing to account for the wide range of damages suffered by the victims.

These two plans were rejected by the U.S. Supreme Court in Amchem Prods., Inc. v. Windsor, 521 U.S. 591, 617 (1997) and Ortiz v. Fibreboard Corp., 527 U.S. 815 (1999).

With Intent to Deceive

Knowing that the Johns-Manville Corporation had a history of hiding evidence of the damages its employees were suffering as a result of asbestos exposure, Ronald Motley, a South Carolina attorney had a rather unflattering opinion of the company. He described them as "the greatest corporate mass murderer in history." One example is a memo from the company's medical director to its corporate headquarters that read:

"The fibrosis of this disease is irreversible and permanent so that eventually compensation will be paid to each of these men. Synergistic Effect (Between Cigarette Smoking and Asbestos Exposure)

Research shows a severely multiplied risk of lung cancer in smokers who have been exposed to asbestos–as much as 90 times the risk! To complicate matters further are the individual disease risks that come from both exposures, and further yet are the interactions of these diseases when more than one is present.

Smoking is known to cause lung cancer and chronic obstructive lung disease (COPD). COPD includes chronic bronchitis, emphysema and asthma. These diseases cause inflammation of the lungs, airways and alveoli. This produces mucus, swelling of the airways (which swell inwards, narrowing them), and air trapping. Air trapping stretches the fragile alveolar sacs, destroying their unique structure, and ultimately reduces the amount of oxygen entering the blood stream and increasing the carbon dioxide that remains in the bloodstream.

Asbestos can cause asbestosis, a restrictive disease resulting from scar tissue. With restrictive disease the lungs cannot expand fully, and the alveoli, normally a thin membrane, has thickened from scar tissue that can neither expand nor allow gas exchange to occur fast enough to support a healthy state.

A synergistic effect is a multiple, rather than an additive effect. That is, the effects are not just added together, but each condition exaggerates the effects of the other condition so that the results are worse than the sum of the effects of each, alone.

A smoker with a history of asbestos exposure can reduce his risk of lung cancer dramatically. After 10 years of non-smoking, this risk can drop to as little as twice that of the general population.

Mesothelioma is often referred to as an incurable cancer. This is true because a cure has not been found. But, what is misleading are statistics supporting a life expectancy of six to twelve months after diagnosis. The reason this is misleading is that such data tend to steal hope from patients who might otherwise beat these odds, especially in light of recent clinical trials that show such promise.

Stories of survivors of fifteen years and counting offer reassurance, hope, and encouragement about how they overcame these odds. They have many things in common, starting with a short period of grieving and a sense of hopelessness, followed by rebounding with a commitment to fight their disease.

Each had decided that they had nothing to lose by following every channel of treatment. They visited doctor after doctor until they found on who offered either conventional treatment or helped them get into a clinical trial.

They learned everything possible about their disease, including epidemiology, standard treatments, alternative treatments, dietary options, support groups, and lifestyle changes. Along with submitting to the care of a physician whom they trusted, many learned to meditate, enjoy life in the moment, join prayer groups and request prayers, try holistic treatments and diets, and learn to live a full life despite the dim prognosis.
